We are proposing that NZQA be given the discretion to cancel a PTE’s registration when the PTE is convicted of allowing a person to undertake a course of study that they are not entitled to do under the Immigration Act 2009.

Currently, NZQA must cancel the PTE’s registration. But this can be a disproportionate consequence (especially as there are also penalties under the Immigration Act). We want NZQA to be able to choose whether the situation is serious enough to cancel the PTE’s registration. In some cases, other remedies may be more appropriate.
